The Buyer" and the terms "you", "your" and "yours" mean the person who agrees to buy Goods and Services from modborn through the Website.

"Goods" and "Services" mean the goods and/or services agreed to be supplied by Modern Furniture to the Buyer under an agreement of sale.

"The Website" means Modern Furniture's website - currently ( http://modborn.net  )

This website is owned and operated by Modern Furniture's - a web based furniture retailer, "we" or "us" "our" or Modern Furniture Office in California, United States.

By placing order (s) with us you will be deemed to have read, understood and agreed to these Terms and Conditions.  All other terms and conditions, including those that may be proposed in any order submitted by you, are expressly excluded and shall have no effect.

 If you need any clarification on anything within these Terms and Conditions then please contact us at sales@modborn.net  prior to placing an order. These terms relate to sales over the Internet only.  Separate terms and conditions apply to purchases made directly from our store/warehouse.

General

These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. 

Pricing and payment

We are very careful to ensure that all our prices are correct. However, if we on a rare occasion we discover an error in the price of goods you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price, or cancelling it. If we are unable to contact you we will treat the order as cancelled, and will give you a full refund. Payment will be taken in full at checkout.

The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed. We are entitled to make adjustments to the price to take account of any increase in our supplier’s prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform you of the correct price and give you the opportunity to cancel the order. As previously stated should the price change or be incorrect the contract is void and must be restarted by you the consumer.

 

Payment Methods 

We accept all major credit and debit cards including American Express, Visa, Visa Electron, MasterCard and Maestro.  When ordering you must provide us with your exact billing address and telephone number - the address and phone number your credit card bank has on file for you. Incorrect information will cause a delay in processing your order. Your order will only be processed once authorization of your credit card has been properly received. You may also pay by cheque or money transfer although we cannot dispatch the goods until payment has been cleared which can take approx. 5 days. Please send email at sales@modborn.net for Bank account details.
 

Availability of Goods 

All products and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for these and we will refund any money already paid for them. However, we will not be responsible for compensating you for any other losses you may suffer if we do not supply the goods. The majority of items offered for sale on this website are in stock and available for fast delivery. Items that are not in stock are ordered in and may take up to 10 weeks to deliver, please contact us to check availability. 

Delivery

Our standard furniture delivery charges apply to North American addresses only. Additional charges may apply to furniture deliveries to USA/Canda/Mexico. When an order contains more than one furniture item, all furniture items will be delivered at the same time as soon as all items are available. An estimated delivery timescale is associated with each furniture product and we will make every effort to deliver your goods within this timescale. However delays can occasionally occur due to unforeseen factors out with our control. Modborn shall be under no liability for any delay or failure to deliver the products within estimated timescales. Please note that all deliveries are kerbside and do not include installation. 
 

Accuracy of Product Information 

All product specifications, images and other information published on our website have either been made accessible by suppliers, manufacturers, publications, publicists, or been gathered from public-domain sources. Our intention is that all information on the website should be as accurate and up to date as possible. However, we cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual. 

Typographical Errors 

In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers,  we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges). 

Cancellation

You may cancel your order at any time by contacting us on sales@modborn.net   . If your goods have not been dispatched, other than as detailed below, we will refund the full price of the items and any delivery charge to the same card account you used to purchase the goods. If you decide to cancel items (before delivery has taken place) that are bespoke, made-to-measure or have been specially ordered for you, it may be unlikely that we will be able to sell these at the full selling price to another customer. In these instances, we have the right to deduct a cancellation fee from your refund.

If you are not totally satisfied with your purchase for any reason, you have the right to cancel your order within 3 working days from date of delivery for full credit or refund less any applicable delivery charges. Goods returned outside period will be subject to a restocking fee of 30%. It is your responsibility to return any such items in a pristine saleable condition in their original box and packaging. You will be wholly responsible for the return of the goods and any associated costs of return. We do not uplift items. Goods received back incomplete, damaged or in any condition other than saleable, will be returned to you and the cost of return carriage charged to your account. Prior to returning any products, please contact us within 3 days from the date of delivery. If you do not return goods within 7 days after you have informed us that you wish to cancel your order, your right to cancel will be revoked. The cancellation must be put into writing and received within the 7 day period. 

We will endeavor to avoid any such charges but in some instances this may be unavoidable.


Returns policy

It is important to us that you are happy with your furniture purchase. If you are not totally satisfied you can return it with in 14 day period.   We offer 14 day money back guarantee starts when customer receives and signs for the product. Please note all shipping costs, packaging and handling costs are non-refundable and customer must return the products to our address.  You have the right to return a faulty item bought from us within a reasonable period of time. If the item was damaged in transit or the wrong item was delivered, you should notify us within 2 days of receipt of the item.  
 
We recommend keeping all packaging and enclosures that accompanies the item for as long as possible after delivery, as this may be required should you need to report a problem. Item should be returned in NEW, unused and unassembled condition. When returning an item to us it is your responsibility to ensure that the item is packaged properly and carefully so that no damage is caused to the item.
 
You will receive a full refund, minus any delivery or special packaging costs which you will be responsible for paying. Unwanted items need to be returned in their original packaging with all original enclosures and  'as NEW' state, or else a refund will not be possible.

General care

The product(s) supplied are to be used for the purpose and in the manner for which they were designed. Most manufacturers include care and maintenance advice with their products, which should be read and followed. No responsibility will be accepted for damaged caused by cleaning if the care and maintenance instructions have not been followed

Warranty / Guarantee

We are so confident in the quality of our products that we offer a 14 day money back guarantee starts from the time customer receives and signs for the product. All products are also covered by a 12 months manufacturer's warranty.  This warranty specifically excludes faults caused by accident, neglect and misuse.  This warranty does not cover leather, foam and material damage beyond normal wear. The cost of the service call will be charged to the customer if we find no fault with the product. Should your item develop a fault within a first 14 day of purchase you may return it for a full refund providing you return the item in the same condition as supplied. This does not affect any statutory rights.
 
If you wish to return the item, we will refund your item price. Please note that all shipping costs are not refundable.
